
We offer full representation to both sellers and buyers.
- You have a choice between customer level services or client level services. We distinguish between agency disclosure and agency election and you will not be required to decide how you wish to work with our associates until we have discussed the choices available to you.
- If you desire a Client Relationship, your decision should be made as early as possible to maximize our ability to advocate on your behalf. Under New Hampshire License law, a contract that spells out our respective duties is required.
- If we are already representing the seller in a particular property that you may be interested in and you wish to also be represented, we can accommodate you under the limitations of Disclosed Dual Agency. This requires both you and the seller to give full written consent, prior to the formulation of a purchase and sale agreement.
Buyer Customers are not represented by our associates and must advocate for themselves. Our associates must treat the Customer honestly and disclose all material facts. We can provide many valuable services but will have a duty to negotiate the best price and terms for the seller. If you choose a Customer relationship, please be aware that any information you provide to our associates must be conveyed to the seller. Please do not share any information you feel should be kept confidential.
Buyer Clients receive a higher level of service in that their interests are protected by the fiduciary duties of obedience, loyalty, disclosure, confidentiality, accountability and reasonable care. This means that our associates can advocate on your behalf to negotiate the best price and terms for you as well as providing many other valuable services.
Under Disclosed Dual Agency the duties owed to both the seller Client and the buyer Client are modified as the goal is for both to receive fair and equal treatment. Our associates cannot disclose information between the Clients without written permission from each respective Client. Therefore the duties of obedience, loyalty and confidentiality must be limited to ensure that any advocacy is not to the detriment of the other party.
